[Mir's Global Radar]Lotte Choco Pie Cleared in India's Referral Lab Retest After Recall Controversy

Lotte India has announced that a batch of its Choco Pie products, previously subject to a recall following a preservative-related controversy in India, has met applicable food safety standards in a retest conducted by a government-recognised referral laboratory. The findings mark a significant development nearly two months after food safety authorities in Chhattisgarh declared the batch unsafe.
Notably, the latest examination differed from the privately commissioned testing previously presented by Lotte. This time, the Durg Food and Drug Administration (FDA) forwarded the disputed sample to a referral laboratory recognised by the Food Safety and Standards Authority of India (FSSAI). However, it remains unclear whether the findings have resulted in the formal withdrawal of the original regulatory restrictions.
Indian media outlets Indian Television and Business Scanner reported on October 14 that Lotte India had announced the findings of the National Food Laboratory in Ghaziabad, which confirmed that the disputed Choco Pie sample complied with applicable Indian food safety standards.

Durg FDA Refers Disputed Sample to National Laboratory, Which Finds Compliance
According to Lotte India, the latest examination was conducted at the National Food Laboratory in Ghaziabad, a referral laboratory recognised by India's Food Safety and Standards Authority.
The sample belonged to Batch No. NM10DC2, manufactured on April 10, 2026, which had been subject to regulatory action by the Durg FDA in August.
Lotte India exercised its statutory right to seek referral testing to challenge the earlier findings. Following the request, the Durg FDA forwarded a sample from the disputed batch to the National Food Laboratory in Ghaziabad.
The company stated that the laboratory's findings confirmed the sample met all applicable food safety standards and regulatory requirements.
The significance of the latest findings lies partly in the status of the testing institution.
In August, Lotte had relied on a separate examination conducted by a privately commissioned third-party laboratory. The latest test, however, was carried out by an FSSAI-recognised referral laboratory following the submission of the sample by the food safety authorities themselves.
This distinction gives the latest results greater regulatory relevance than the company's earlier privately commissioned testing.
Nevertheless, the findings have been disclosed through Lotte India's public statement. The complete laboratory report, including detailed measurements, and any subsequent final administrative decision by the authorities require separate verification.

Conflicting Preservative Test Results: Controversy Enters New Phase After Two Months
The controversy began in August when food safety authorities in Durg, Chhattisgarh, raised concerns about the preservative content of a specific production batch of Lotte Choco Pie.
Following laboratory testing, the authorities classified the batch as unsafe and imposed restrictions on its sale, storage and distribution, alongside recall measures.
The issue subsequently extended beyond Durg. Food safety authorities in Raigarh, another district in Chhattisgarh, also instructed retailers and distributors to stop purchasing, selling and storing products belonging to the same batch.
Lotte India disputed the initial findings, presenting results from an independent third-party laboratory that it said demonstrated compliance with the applicable preservative limits.
A test report dated August 18 from Interstellar Testing Centre in Chennai recorded a sorbate concentration of 957.65 mg/kg in the disputed sample.
Lotte maintained that the measured concentration was within the legally permitted limit.
However, the report itself did not provide a separate regulatory compliance determination or specify the applicable legal threshold. Its "Opinion/Interpretation" section was marked "NA."
Consequently, the earlier dispute involved conflicting positions between the food safety authorities, which had classified the batch as unsafe, and Lotte India, which maintained that independent testing supported its compliance.
The latest findings from the National Food Laboratory represent a new development because they emerged from a statutory referral-testing procedure rather than another independently commissioned private examination.
However, a laboratory finding of compliance and the formal withdrawal of an administrative order are separate matters.
As of the latest available reports, no independently verified decision has established that the Durg FDA formally revoked its earlier restrictions or declared the recall process officially completed.

Lotte India Reaffirms Consumer Safety Commitment as Regulatory Decision Remains Pending
Lotte India said the latest laboratory findings reaffirmed its commitment to product safety and quality assurance.
Milan Wahi, Managing Director of Lotte India, emphasised in the company's statement reported by Indian media on October 14 that consumer safety and trust remained its highest priorities.
He explained that the company had responded promptly and responsibly when the issue first arose, including undertaking a precautionary recall of the affected batch while the evaluation process continued.
The company also reiterated its commitment to maintaining high standards of food quality and safety and protecting the confidence of Indian consumers.
Lotte India has consistently maintained that the controversy concerned a specific production batch and did not constitute a blanket prohibition or an unsafe classification covering all Lotte Choco Pie products.
The development also carries implications for Lotte's broader operations in India.
Choco Pie is one of the company's established confectionery brands in the Indian market, where Lotte Wellfood has been expanding its local manufacturing capabilities and production capacity.
For a food manufacturer seeking to strengthen its presence in a major consumer market, the outcome of a regulatory safety dispute can influence brand confidence, distributor relationships and future business operations.
Nevertheless, it remains to be confirmed whether the latest referral laboratory findings have led to the formal lifting of sales and distribution restrictions or the completion of the recall process.
The next critical development will be the response of the Durg FDA and the Chhattisgarh food safety authorities to the National Food Laboratory's findings.
Any official decision to withdraw or amend the earlier regulatory measures would represent a further significant development in the dispute.
For now, the case has moved beyond the company's earlier privately commissioned test results to findings from an FSSAI-recognised referral laboratory, while the final administrative outcome remains to be established.
