그동안 형법상 간첩죄는 사실상 북한과 같은 ‘적국’을 위한 간첩행위에 초점이 맞춰져 있었다. 하지만 반도체·배터리·인공지능(AI) 등 첨단기술이 국가 간 패권 경쟁의 핵심 무기로 떠오르면서 기존 법체계만으로 산업스파이에 대응하기 어렵다는 지적이 커졌다.

파이낸셜타임스(FT)는 최근 한국의 간첩죄 확대를 집중 조명하면서, 배경에 삼성전자와 SK하이닉스를 비롯한 한국 반도체 기업의 기술을 보호해야 한다는 절박감이 자리잡고 있다고 분석했다.

이제 반도체 기술을 지키는 문제는 개별 기업의 영업비밀 보호를 넘어 국가안보의 영역으로 이동하고 있다.

Stealing advanced semiconductor technology from Samsung Electronics or SK Hynix and transferring it to a foreign entity could now expose offenders to espionage charges in South Korea.

The country has changed a legal framework that had remained largely intact for more than seven decades.

South Korea’s espionage law had traditionally focused on activities benefiting an “enemy state,” effectively centering on North Korea. But as semiconductors, batteries and artificial intelligence have become strategic assets in global competition, concerns have grown that the existing legal framework is insufficient to counter industrial espionage.

The Financial Times recently highlighted South Korea’s expanded espionage law, linking the change to mounting pressure to protect critical technologies held by companies such as Samsung Electronics and SK Hynix.

Protecting semiconductor technology is increasingly moving beyond corporate trade-secret protection and into the realm of national security.

이번 변화의 핵심은 간첩행위의 상대방을 사실상의 ‘적국’에서 외국 또는 외국 단체까지 넓힌 데 있다.

FT에 따르면 개정된 법체계에서는 국가안보에 영향을 미칠 수 있는 비공개 경제·과학·기술 정보가 ‘국가기밀’에 해당하고 이를 외국 측에 넘긴 사실이 입증될 경우 간첩죄 적용이 가능해진다. 최고 형량은 징역 30년에 이를 수 있다.

왜 지금 이런 강력한 법이 등장했을까. 반도체 경쟁의 방식 자체가 달라졌기 때문이다.

과거 반도체 경쟁은 누가 더 많은 공장을 짓고 더 미세한 공정에서 제품을 생산하느냐의 싸움이었다. 하지만 기술 격차가 좁혀지면서 경쟁사의 핵심 엔지니어와 제조 노하우, 공정 데이터, 장비 운용기술을 확보하는 것 자체가 경쟁력을 단기간에 끌어올리는 수단이 되고 있다.

특히 메모리 반도체 세계 최상위권인 삼성전자와 SK하이닉스가 보유한 공정기술과 엔지니어 경험은 돈만 투자한다고 단기간에 확보할 수 있는 자산이 아니다.

공장 설계부터 수율 관리, 장비 배치, 공정 조건까지 수십 년 동안 축적된 ‘암묵지’가 반도체 경쟁력의 상당 부분을 차지하기 때문이다.

FT가 한국의 간첩죄 개정을 삼성전자·SK하이닉스와 중국 반도체 산업의 추격 구도 속에서 바라본 이유도 여기에 있다.

Why is industrial espionage being treated like spying now?

The key change is the expansion of potential beneficiaries of espionage from an “enemy state” to foreign countries and foreign entities.

According to the Financial Times, non-public economic, scientific and technological information capable of affecting national security can fall within the scope of protected national secrets. If such information is proven to have been stolen for a foreign entity, offenders can face espionage charges carrying sentences of up to 30 years.

Why introduce such a powerful legal weapon now?

The nature of semiconductor competition has changed.

Chip competition was once largely about who could build more fabrication plants and manufacture products using more advanced processes. As technology gaps narrow, however, recruiting key engineers and obtaining manufacturing know-how, process data and equipment expertise can dramatically shorten a competitor’s development timetable.

The accumulated expertise held by Samsung Electronics and SK Hynix cannot simply be replicated through capital investment.

Decades of tacit knowledge — from fab design and yield management to equipment configuration and process optimization — constitute a critical part of semiconductor competitiveness.

That is why the FT viewed South Korea’s legal change against the backdrop of intensifying competition between Korean chipmakers and China’s rapidly advancing semiconductor industry.

숫자를 보면 한국 정부가 기술유출을 국가안보 문제로 바라보기 시작한 배경이 더욱 분명해진다.

FT에 따르면 한국에서 적발된 산업기술 해외유출 사건은 2025년 33건으로 역대 최대 수준을 기록했다. 이 가운데 절반 이상이 중국과 관련된 것으로 나타났다.

더 주목할 부분은 기술유출의 상당 부분이 대기업 자체보다 상대적으로 보안 시스템이 취약한 중소기업에서 발생한다는 점이다. FT는 전체 사건의 86%가 중소기업과 관련됐다고 전했다.

기술을 훔치는 방법도 영화 속 산업스파이와는 다르다. 공장에 몰래 침입해 설계도를 훔쳐가는 방식보다 핵심 기술을 알고 있는 퇴직 엔지니어에게 기존보다 훨씬 높은 연봉을 제시하거나 해외 페이퍼컴퍼니 등을 이용해 인력을 영입하는 방식이 활용된다.

결국 반도체 기술유출의 핵심 통로는 ‘사람’이다.

삼성전자와 SK하이닉스가 아무리 보안 시스템을 강화해도 수십 년간 현장에서 일한 엔지니어의 머릿속에 들어 있는 경험과 노하우까지 회사 안에 묶어둘 수는 없다.

반대로 지나친 이직 제한은 개인의 직업 선택 자유와 충돌할 수 있다. 한국이 간첩죄라는 강력한 수단을 꺼냈지만 법 하나만으로 기술유출 문제를 해결하기 어려운 이유다.

The numbers help explain why South Korea increasingly views technology leakage as a national security issue.

According to the FT, South Korea detected a record 33 cases of overseas industrial technology leakage in 2025, with more than half linked to China.

Another notable vulnerability lies outside the largest corporations. The FT reported that small and medium-sized companies accounted for 86% of the cases, highlighting weaker security systems across the broader semiconductor supply chain.

Technology theft also looks very different from the industrial espionage depicted in movies.

Instead of physically stealing blueprints from factories, foreign competitors may seek out retired engineers with lucrative salary offers or recruit experienced personnel through intermediary or shell companies.

The critical channel for technology leakage is therefore often people.

No matter how sophisticated the security systems at Samsung Electronics and SK Hynix become, companies cannot completely contain decades of accumulated knowledge carried by experienced engineers.

At the same time, excessive restrictions on job mobility can conflict with an individual’s freedom to choose employment.

That is why stronger espionage laws alone cannot completely solve the problem.

한국이 더 긴장하는 이유는 중국 반도체 산업의 성장 속도다.

중국은 미국의 첨단 반도체 장비·기술 규제에도 불구하고 막대한 투자와 자국 공급망 육성을 통해 반도체 자립을 추진하고 있다.

특히 메모리 분야에서는 창신메모리테크놀로지(CXMT)를 비롯한 중국 기업들이 생산능력을 빠르게 확대하며 삼성전자와 SK하이닉스가 장악해온 시장을 추격하고 있다.

여기서 한국 반도체 산업의 딜레마가 생긴다.

공장은 새로 지을 수 있다. 장비도 돈을 들여 구매할 수 있다. 하지만 수율을 끌어올리는 방법과 미세공정에서 발생하는 수많은 문제를 해결하는 경험, 차세대 제품을 설계하는 노하우는 돈만으로 하루아침에 만들 수 없다.

삼성전자와 SK하이닉스가 진짜 지켜야 할 자산은 거대한 반도체 공장 자체보다 그 안에서 축적된 기술과 사람인 셈이다.

한국이 70여 년 만에 간첩죄의 문을 외국 산업스파이에게까지 넓힌 것은 그래서 상징적이다.

반도체 기술 한 건의 유출이 기업 하나의 손실로 끝나는 시대가 아니라는 의미다.

AI시대가 본격화하면서 HBM을 비롯한 첨단 메모리는 데이터센터와 AI 가속기, 군사·우주·통신 인프라까지 연결되는 전략 자산이 되고 있다.

반도체를 둘러싼 세계의 경쟁도 이제 ‘누가 더 좋은 칩을 만드느냐’를 넘어 ‘누가 자신의 기술을 끝까지 지켜내느냐’의 싸움으로 바뀌고 있다.

삼성전자와 SK하이닉스의 초격차 경쟁은 공장 안에서만 벌어지는 것이 아니다.

공장 밖에서 벌어지는 ‘기술 방어전’ 역시 한국 반도체의 미래를 좌우하게 됐다.

China’s pursuit…Samsung and SK must protect more than factories

South Korea’s concern is heightened by the speed of China’s semiconductor development.

Despite U.S. restrictions on advanced semiconductor equipment and technology, China continues to pursue chip self-sufficiency through massive investment and the development of domestic supply chains.

In memory chips in particular, Chinese companies including ChangXin Memory Technologies (CXMT) have been expanding capacity as they seek to challenge markets long dominated by Samsung Electronics and SK Hynix.

This creates a fundamental dilemma for South Korea’s semiconductor industry.

Factories can be rebuilt. Equipment can be purchased.

But the experience required to improve yields, solve countless problems in advanced manufacturing processes and design next-generation products cannot be acquired overnight simply by spending money.

The most valuable assets Samsung Electronics and SK Hynix need to protect are therefore not merely their enormous fabrication plants, but the technology and people inside them.

South Korea’s decision to expand its espionage law after more than 70 years is symbolic for precisely this reason.

A single technology leak is no longer viewed merely as a loss suffered by one company.

As the AI era accelerates, advanced memory products such as HBM are becoming strategic assets connected to data centers, AI accelerators, military systems, space technologies and communications infrastructure.

Global semiconductor competition is consequently evolving from a race over who can manufacture the best chips into a contest over who can protect critical technology most effectively.

For Samsung Electronics and SK Hynix, the battle for technological leadership is no longer confined to the factory floor.

The ability to defend technology outside the fab may increasingly determine the future of Korea’s semiconductor industry.
